Municipal Law and Litigation

Lafayette Municipal Lawyers

At Becker & Hebert, our lawyers have devoted much of our practice to representing local governments in a variety of issues. We routinely represent Louisiana local governments in a variety of capacities.  One of the firm’s principals, Michael Hebert, has served both as the Lafayette City Attorney and as the Lafayette City-Parish Attorney, and the firm’s lawyers have represented a number of other local governmental agencies, including the Lafayette Planning and Zoning Commission, the Lafayette Board of Zoning Adjustment, and the Lafayette Public Trust Financing Authority.

In addition to our long history with the City of Lafayette and Lafayette City-Parish Consolidated Government, we have represented over 50 Louisiana local governments and are capable of providing full service across the full spectrum of local government operations, including, but not limited to, the following:

  • advice in development of governmental policy and legislation;
  • drafting of actions and declarations of government agencies such as ordinances, resolutions, and policy statements;
  • advice and litigation regarding validity of governmental actions;
  • representation of local governments in tort claims and litigation, including police liability, intersection and railroad crossing design, civil rights claims, and miscellaneous personal injury and property damage claims; advice and litigation regarding land use regulation and zoning;
  • municipal annexations and related issues;
  • rights of governmental employees;
  • expropriation and rights of eminent domain;
  • civil service issues;
  • publicly owned utilities;
  • franchise and right of way issues;
  • public bidding and procurement issues;
  • public access issues, including public records law and open meetings law issues;
  • disputes between branches of government
  • public-private partnerships, including tax-increment financings (“TIF’s”) and payments-in-lieu-of taxes (“PILOT’s”)
  • land use and regulatory issues.

In these positions, our attorneys have successfully performed a variety of functions for the city of Lafayette, including advising and interpreting various laws and ordinances, providing research and opinions to various legal questions, drafting regulations and ordinances, and representing the city in litigation.
